Design Policy

We will accept inspiration photos; however none will be duplicated, including our past creations. We will make every effort to provide exactly the flavors, fillings, decorations, sizes, shapes and colors you have requested, the creation of our items is an art and may be subject to slight variations and/or errors by the creator(s). We will not guarantee to match colors or duplicate an item exactly. We hold all final say in decisions regarding the creation of our products.

 

 

Servings

Serving sizes are based on the industry standards. As long as the cake is cut according to the industry standard, Schwartz & Sprinkles Cakes warrants all cakes will provide at least the lower number of servings in the serving count chosen. If cake is cut smaller than the industry standard, the serving count will rise accordingly, but the pieces will be smaller.

 

 

Placing Order

The more information you provide, the easier we can bring your vision to life! Upon placing your order, please provide the date of the event, number of people, cake flavor, frosting flavor, theme/vision/details you are seeking, and preference on round/square/sheet/tiered cake.

 

Changes in size and detail must be given two weeks prior, as custom cakes require a lot of planning and preparation.

 

 

Deposit and confirmation

50% non-refundable deposit is due upon placing your order to secure Schwartz & Sprinkles.  Your date is held for 48 hours after your confirmation email is provided, if we do not receive the 50% deposit within that period, we will release your date.  We only accept a limited amount of orders per month and we cannot hold a date without a deposit.  The remaining balance is due 1 week prior to the event date given at time of order.

 

We accept cash, venmo or cashapp at this time. We do not accept checks or e-checks.

If you change your date, we will make every effort to accommodate the new date, however, if the new date is not available, we will consider your event canceled and our cancellation policy will apply.

 

Cancellation

50% deposit is non-refundable but may be transferrable. When we take your order, we begin the process of declining other orders and possibly purchasing supplies for your order.  As we get closer to your date, the chance of re-booking your date is greatly reduced. Cancellations after 1 month before your event may be transferred to a different date. Cancellation after 1 week before your event will result in no refund, full payment will be due to Schwartz & Sprinkles Custom Cakes.  The design of the cake toppers and décor begin days prior to the order date due to drying and multiple steps.  Additionally, items are purchased in advance which may not be refundable.  For these reasons, we must implement the cancellation policy.

 

Changes in cake order

Any changes in design, serving amount, flavors, colors etc. must be made two weeks prior to your date cake is needed.  Changed could result in an increase in the total cost.  Any additional charges incurred from a change will be due with the final payment.

 

Credit Policy

Any discrepancy with a product after it has left our possession must be documented with a photo of the product which clearly shows the discrepancy and emailed to us, or by returning the product to us within 24 hours of pick-up.  Credits will not be honored without proof of discrepancy.  We do not issue refunds. NO EXCEPTIONS. We do not give credits unless a mistake was made on our part.  Mistakes DO NOT include decor details such as but not limited to color, shades, tones, writing font, decor placement, etc. This is due to the cake being art & every artist has their own style.  If you send an image you would like us to recreate, we will make every effort to recreate the look as closely as possible, but it may not be identical as each cake designer has their own unique artistic style and ability just like each individual’s handwriting is unique to them!

 

 

Use of Fresh Flowers on Cake

Please be aware that not all flowers are edible and some can be toxic, aside from being covered in pesticides.  It is your responsibility to contact a florist to discuss the safest flowers for a cake, proper preparation for the flowers to be placed in a cake etc.).  I will make every effort to prepare them appropriately before placing the stems in the cake. Schwartz & Sprinkles is not liable for any issues with the flowers due to storing the cake, wilting, color change, shedding, dying etc.  We are not versed in flower preparation or life expectancy.  We do not recommend placing the flowers on the cake until serving time.

 

 

Cake Tasting

We do not offer cake testing, however, you are welcome to purchase cupcakes or a small cake to get an idea of our flavors. 

 

Release of Liability

Schwartz & Sprinkles is not liable for any damage to cake from client transporting, once it leaves our hands.  If delivered, we will make every possible effort to create and safely deliver your cake.  We shall have no responsibility to the condition of your cake once delivered to you or your venue.  Once delivery and if needed, setup, is complete, we shall not assume any responsibility for your guest’s, florist’s, caterer’s or any other person’s acts with regard to your cake, or any property damage or injury that occurs as a result of our services and/or provision of your cake. High temperatures can adversely affect your cake. It is your responsibility to ensure the cake is placed in a spot that is out of direct sunlight and away from unnecessary heat. 

 

Photography

Schwartz & Sprinkles Custom Cakes reserves the right to photograph your cake for our own reference, display or promotional advertising without compensation to

 

Delivery & Setup

We deliver orders of $75 or more. Deliver up to 10 miles from our address in Spring City for $20. We do not deliver over 10 miles one way.  Order must be paid in full prior to delivery. We will make every effort to deliver your cake at the agreed upon time, however, we likely are delivering multiple orders which may cause us to unforeseeably run behind schedule.  If this occurs, we will notify you immediately.

 

Schwartz & Sprinkles Cakes will take photographs of the completed cake set up to record the cake for a professional portfolio, and also as proof of delivery and setup. These photographs will constitute legal proof of Schwartz & Sprinkles Cakes having fulfilled its contractual obligations with respect to design, construction and delivery of the cake.  The client is responsible for ensuring the location of delivery has the following at time of delivery:

• An appropriate and secure environment for the cake, including a sturdy, flat and level table capable of supporting the weight of a cake without wobbling, tipping or moving.

• A place for the cake that is away from all heat sources and sources of vibration (including dance floors, band amplifiers, and high-traffic areas.)

• If outdoors, a setup area that is not in direct sunlight.

• Whether indoors or outdoors, a temperature-controlled area at 68-72 degrees from cake delivery time until the time it is served.

 

 

Storage

For fondant-covered cakes, the fondant seals the cake, which extends the shelf life.  A boxed, fondant-covered cake at room temperature can last up to 5 days.  If refrigerated and boxed may extend its approximate shelf-life.  The more airproof the box, the longer the shelf life.

 

Buttercream-covered cakes, last approximately 5 days.  Refrigeration is not necessary. If you decide to, it is best to seal the cake box in plastic wrap, as most refrigerators have high humidity which can cause water droplets to form.  You may freeze the cake. 

 

Please keep cake out of heat, buttercream will melt and fondant will droop.  If this occurs, no refund will be provided.  We recommend keeping in air condition.

 

Allergy Warning

Our products may contain eggs, corn, gluten and milk. While none of our products contain nuts, the facility in which the products are made is not nut-free.  I use and keep a wide range of items in my kitchen, which include nuts and shellfish. I do keep such items in containers to help reduce the risk of contact with other items. With this note, please be aware that I cannot be responsible for any allergic reactions.

 

Unless provided with advanced notice, Schwartz & Sprinkles Cakes does not cater to specific allergy restrictions. Any food allergies MUST be discussed in detail with Schwartz & Sprinkles Cakes before choosing cake flavors. It is the responsibility of the client to alert any individuals with allergies to potential allergens in the cake. Upon request, Schwartz & Sprinkles Cakes can furnish the client and/or the reception venue coordinator with an ingredient list with allergen information.

 

Natural Disasters/ Acts of God

Performance of this agreement is contingent upon the ability of Schwartz & Sprinkles Custom Cakes, LLC, to complete this agreement when delay or default is caused by conditions beyond its control, including but not limited to, Acts of God, Government restrictions, weather, and or any other causes beyond the reasonable control of the company.

 

Limitations of Liability

If Schwartz & Sprinkles Cakes cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic or weather, fire, terrorism or other causes beyond the control of the parties, or due to the baker's illness, then Schwartz & Sprinkles Cakes shall return any money paid by the client, less expenses, but shall have no further liability with respect to this agreement.  In the event Schwartz & Sprinkles Cakes fails to perform for any other reason,  Schwartz & Sprinkles Cakes shall not be liable for any amount in excess of the money the client has paid.  In the event of personal emergencies that prevent Schwartz & Sprinkles Cakes from doing the delivery and setup, Schwartz & Sprinkles Cakes will attempt to make arrangements with alternate cake providers to do the work, and will provide refunds to the client in proportion to the amount of work Schwartz & Sprinkles Cakes was not able to do. In the event that any of the above conditions prevents Schwartz & Sprinkles Cakes from delivering a completed cake, no refunds will be issued, but the client will be given the option of picking the cake up the day of, or within one day of, the originally scheduled event.

 

 

Governing Law and Jurisdiction

This Agreement shall be governed in accordance with the laws of Chester County, Pennsylvania.  The parties consent to the exclusive jurisdiction and venue of the federal and state courts located in Chester Count, Pennsylvania in any action arising out of or relating to this Agreement. The parties waive any other jurisdiction to which either party might be entitled by domicile or otherwise.

 

Severability and Integration

            If a court finds any provision of this Agreement invalid or unenforceable, the remainder of this Agreement shall be interpreted so as best to effect the intent of the parties. This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations and understandings. This Agreement may not be amended except in a writing signed by both parties.

 

Agreement

            Completing the order form and submitting, acknowledges that you first read our above Terms & Conditions and accept them.
